Conservative Constitutional Lawyer Kaplan has just filed a motion to disqualify Trump from appearing on state ballots in Florida due to a violation of the 14th Amendment’s insurrection clause. I suspect this will fail in Florida, but will eventually make its way to the Supreme Court by some time next year. Interesting how this will go because the logic is there. If he is convicted guilty in the January 6th trial I think this has a legit shot of passing. I also think this will greatly help Republicans as it will force a divorce between them and Trump. The Republican Party has proven to be very successful when not associated with Trump and this will allow a non-Trump GOP candidate without threat of a third party Trump.

These are definitely going accelerate. They would be even more divisive than the charges against Trump, but perhaps less so if they are in fact initiated by fellow Republicans.

He hasn't actually been charged with insurrection though.
A state like California could ban him even though it's irrelevant to president race as a way to get more house seats.

You see, this is where I think the argument might fall apart even if the Washington DC trial gets him convicted as guilty. He is under conviction of fraud not pure insurrection. However, there has been a politician in New Mexico who was in the January 6th crowd barred from holding office, so there is some history. But Trump does have a free speech argument here.

This is where action and words are two different things. Jack Smith even notes that Trump had a right tot lie about the election to people. The putting together of faker electors and pressuring the VP are very different things. The stupidity of this is hilarious. We’ve waited 50 years for this case. Time to find out if the Supreme Court thinks a president should be immune from prosecution. Kind of a no brainer because we are not a dictatorship, but Clarence Thomas might be the most corrupt Justice ever and knows Trump will protect her if the January 6th trial goes forward

I can see the argument that "official" acts should be immune or treated differently, but personal acts should not, hence why presidents can get away with accidentally killing Americans in drone strikes

Supreme Court ruled that as long as you can prove whatever action you take as a president is an official act, you are immune from criminal prosecution. And we are that much closer to becoming a dictatorship

Mixed feelings about it, but if they didn't do it stuff like Obama accidentally killing Americans in drone strike could be charged as murder. So I can see how they would think it's opening up pandora's box if they didn't rule against it, especially since the Republican judges likely realize that the law had been obviously abused for political reasons lately by the anti Trump side.
