Re: Supreme Court overturns DC gun ban
I agree with the ruling, but I think we've moved far beyond gun rights having anything to do with the Constitution. Until the SCOTUS allows us all to own nuclear weapons, then we need to stop pretending that the 2nd Amendment has any relevance.

Is there actually a federal ban on owning nuclear weapons?

There'll be a case for it eventually. I give it another twenty years before some Kaczynski in Montana is caught building his own stockpile. Or when ExxonMobile can invade a country directly.

Krem wrote: Is there actually a federal ban on owning nuclear weapons? This is not about federal law, as the DC law was not federal and was struck down. You as a private individual or not permitted to own a nuclear weapon. In fact, in some states you are not allowed to own several military grade weapons, like howitzers. There's a federal ban on new fully automatic machine guns. In California, you can't even own hollowed-out hand grenades. But more to the point, do you think that any individual US citizen should be able to own nuclear weapons?

I still remember our middle school once had a bomb/grenade scare when some kid unwittingly (or perhaps not so much) brought in some of his dad's stuff to show off to his friends.

Gun Bans don't solve anything.
Its the social issues and the lack of policing.

Re: Supreme Court overturns DC gun ban
There does seem to be a ban on owning/developing your own nuclear weapon. Here's something I found doing a quick perusal. Quote: C. Whoever without lawful authority develops, possesses, or attempts or conspires to develop or possess a radiological weapon, or threatens to use or uses a radiological weapon against any person within the United States, or a national of the United States while such national is outside of the United States or against any property that is owned, leased, funded, or used by the United States, whether that property is within or outside of the United States, shall be imprisoned for any term of years or for life. 18 U.S.C.A. § 832 C (West 2008)

FILMO wrote: So can you own now full automatic weapons in the US or not? I mistakenly cited the Federal Assault Weapons Ban in an earlier post, but that law expired in 2004 and has not been renewed or re-enacted. There are, however, several states that have their own assault weapons bans in place.

Well....So if you live in the right place you can have 300 bullets and a full automatic assault M4 Carbine and 3 hand grenades and go amok with it.....Thats pretty scary!

I'm pretty conservative about my gun control, but I can find no rational reason to need any of that, let alone all of that. The most any typical person would need would be a fairly basic handgun.

Re: Supreme Court overturns DC gun ban
Well I always ask what kind of society do we live in that we needs guns to protect ourselves.
I think Americans should look at that question.

I think Americans should look at that question. We live in a well diverse one that doesn't expect the law to always be there and protect us when we need them too.

You should, according to the Constitution and the NRA, have the right to bear any arms. A mobile tank killer is ideal for self-defense and for hunting.

Re: Supreme Court overturns DC gun ban
Of course, I'm waiting for the outrage, yes outrage, from the anti-"judicial activism" crowd. Wasn't this just another case of the courts overstepping their bounds and dictating public policy over the executive and legislative branches like they did in the California gay marriage case? Yep. Any minute now. The outrage.

The Constitution was on point, so judicial activism wasn't really an issue here. That's not to say that "conservatives" (for lack of a better word) cannot be activists, see 11th Amendment jurisprudence.

Me: Nothing I say will convince you, so I will leave it at that. What you don't understand is that their is ambiguity to the second amendment about individual ownership of guns and so for some this could be seen as "Judicial Activism" but for the must part that is only a buzzword that only the rigth likes to use so you will not be hearing that here. THis is at heart a case where the law was struck down just like the gay marriage ban. Both were struck down on the merits of the constitution and how the judges interpretted them.
