their advertising the movie as best picture  in commericals for dvd.
like it won that award.

It won ten times as many best picture of the awards. (Compared to Crash)

Seems warranted to me. If anything, Crash shouldn't be advertising itself as BP.

I'm not saying Wal-Mart is homophobic because some won't sell the movie (though it would be another story if all of them refused to sell it), but I'm saying that because of other things I've heard about them in the past. For one, they supposedly don't protect people of different sexual orientations from harrassment. It's not in the employment policy agreement. I know someone whose gay and works at the local Wal-Mart and they get harrassed by other employees for being gay all of the time and the management does nothing about it. In fact, they've been part of the harrassment. So I'm not saying they are homophobic just because they aren't all selling Brokeback Mountain.

That doesn't make them homophobic, that makes them slow to respond to a changing social norm. Also, sexual orientation is a nationally protected harassment clause so if he is being harassed he needs to contact the national offices of Wal-Mart. Likely he signed an arbitration clause so he will have to go through that first before any legal judgement can be brought.

Instead of being a typical gay person and whining and crying because things are unfair maybe he should try to change things, eh?

Not everyone can muster the courage or whatever it takes to stand up against discrimination, harassment, etc. Also, this is a forum where people should feel free to vent their views about whatever they want. If Mike feels that a particular organization isn't doing all that it should to protect their employees against harassment, then by all means let him express it. One of the biggest grass-root causes for "trying to change things" is allowing people to express their views and stimulate a discussion. They have to start somewhere you know.

And also, not all states offer the same kind of protection for victims of harassment/discrination etc (especially related to sexual orientation). In fact, up to 10 states I believe have passed pre-emptive legislation that would bar the creation of such laws pertaining to gays, lesbians. Not sure where the guy Mike was talking about would fall into this, or where Wal-Mart specificaly stands in its policy, but it would definitely be an uphill battle if he were to actually "do something" about it. Like it is for all victims of a crime, I suppose.

As far as the Best Picture comment goes....

They don't say Academy Award Winner for Best Picture. They don't associate it with the Academy. In fact the commercials I have seen don't even say "winner." They merely say "The Best Picture of the Year" and have subtitles on the screen claiming it's from Joel Siegel or some other critic.
