All,

Sanders Law, on behalf of National Photo Group, is currently threatening legal action against WoKJ. The firm is claiming copyright infringement for am image which was embedded in a WoKJ post (never hosted, just linked and embedded with img tags). According to the suit, we are liable for damages between $750 and $30,000 + their legal fees.

The post in question was long ago deleted, so I can't refer back to it for details.

The law firm here is a troll, they are simply looking to extort money, likely around $1000 to $2000 from me and many others. They have sent me one email, and now one letter. It seems I'll get another letter, and then I expect them to file suit (as they have in over 100 cases thus far). Some cases are actively being litigated, none have run to completion. I hate the idea of settling with them, I hate the financial impact of both settling and litigating.

I haven't yet sought legal counsel, but will soon have to do so (when a suit is filed). This is going to be a mess, and could prove to be the end of WoKJ. I'll try to keep you updated.

Umm, there is no way they can actually go through with this, can they? I mean, I could register myself at a dozen of online forums now and just post a picture there and those websites would be sued? For all we know, the law firm itself could embed that picture in a forum.

They can file, but they obviously won't win, but the costs involved, even in a non-win case, are too much for WOKJ, which is basically just a hobby site. This sort of shit makes me sick. These bastards. But surely if they lose, they will have to pay all the fees, no?

I guess if WOKJ is to continue, a no image policy might be sensible, although I hope not.

Represent yourself pro se and fight it. I'd personally think it would be fun. The chances of you losing seems very minimal and I think they would hate to go to trial even more than you would (their hope is that you are terrified of the prospect). If you feel like you might lose, you can always just settle with them.

Of course you should seek legal advice if you are uncomfortable, but hiring a lawyer seems like a cost without any real benefit. The lawyer is going to do the same thing you do (look up past cases and respond similarly).

Wow. How strange and awful. I have honestly never heard of such lawsuits nor did I ever consider there could be any ramifications from the posting of a picture, which I do quite often (to illustrate news stories and such)...

Anyhow, there is no case. The worst they can do is to tell them to take down certain images and since the site makes no profit, they have no case to sue for money. I do remember Ladiesman threatening to sue the website.

Fucking trolls. If the post was deleted long ago how can they prove it ever existed? Can you counter sue over them being a bunch of cunts? I don't think they can win though. How could you be liable for this? If you had refused to take it down after they informed you is one thing, but pulling this bullshit years later can't be legal. They're probably just trying to intimidate you into a quick settlement.
