They don't have a case, they just have scare tactics and a lawyer working for himself. As Groucho can attest, legal counsel isn't cheap, and the issue here is they WILL take this to court. That means me hiring legal counsel to deal with that, which means time, and thus money. Significantly more than what they want to settle, but settling basically means giving up the site as it opens the door to many more trolls looking for a similar handout.

They wouldn't win, I just don't know that I can fight them. Groucho's offer to help is extremely nice, something he didn't have to do. I haven't discussed it with him further in private, but my worry even there is that this type of law is outside his typical practice.

Most folks will just settle then try to deal with it because it takes time, money and you have no clue what to do unless you are a lawyer yourself or hire one which again costs money, but you have a card they don't expect.

Avoid responding to them for as long as you can and hope they move onto someone else. Their end goal is to get settlements, any time they go to court they're going to lose so they'll avoid it. Furthermore going to court increases their visibility and let's Uncle Sam know they're scam artists which I assume is bad for them, or sets them up to be sued later by a defendant. I think there's a good chance if you don't settle immediately this goes away. If I was running this scam I would never go to court, it's sending out hundreds of letters and taking whatever ratio settles, I don't see the motive for them to really go to court
