Post The states that are allowing gay marriage thread
Oh noes! Those crazy liberals have taken over the heartlands!

http://www.google.com/hostednews/afp/ar ... EeYWCvH7cg

CHICAGO (AFP) — The Iowa Supreme Court on Friday struck down a ban on gay marriage as unconstitutional and ruled that the rural midwestern state must allow gay and lesbian women "full access" to the institution of civil marriage.

Only two other US states currently recognize same-sex marriage -- Connecticut and Massachusetts -- while nine others grant some of the legal benefits of marriage to gay couples through "civil unions" or domestic partnership laws.

In a unanimous opinion, the Iowa Supreme Court ruled that the state's ban on gay marriage "violates the equal protection clause of the Iowa Constitution."

Haha, I just posted this in the Vermont thread because I figured we needed just one consolidated thread about this. Oops!

Good, at least people are slowly coming around enough to not be dipshits. I still expect(ed) better from California, though. I wonder what state will be next?

Pretty Awesome. And I just got a email from Fair Wisconsin subject line "Congratulations Iowa!"

Quote:
Dear Loyal,

Fair Wisconsin heartily congratulates our neighbors in Iowa, whose Supreme Court ruled unanimously this morning that the state’s legislation banning same-sex marriage violated their state constitution.

“The Iowa statute limiting civil marriage to a union between a man and a woman violates the equal protection clause of the Iowa Constitution,” the justices said in a summary of their decision. The court rules that gay marriage would be legal in three weeks, starting April 24.

The unanimous decision in Iowa recognizes the importance of allowing someone in a caring, committed relationship to care for and be responsible for their partner. While our state constitution prohibits same-sex marriage in Wisconsin, Wisconsinites overwhelmingly share a commitment to fairness and decency for all couples. That is why we strongly support the domestic partnerships that are part of Governor Doyle’s budget.

Our proposed domestic partnerships would allow a caring, committed couple to have some basic protections they need to care for each other, including hospital visitation, taking family leave to care for a sick or injured partner, and end-of-life decision-making.

To read more about this decision, click here.

Best regards,

Glenn Carlson

Post Gay Marriage is Legal
I'm surprised no one has picked up on this and put a thread for it yet. The Iowa supreme court ruled UNANIMOUSLY that prohibiting gay marriage is unconstitutional, and consequently legalized it. It will take 21 days to process, but on April 24th gay marriage will be officialy legal in the state of Iowa.
I know it's just Iowa, not like California or anything, but a win is a win.
:D

Exactly. If they don't know how to behave, and feel OK offending others, they get their ass kicked, so they'll think next time before opening their rotten mouths.

Yeah, it's very cool. I'm just looking forward to it someday being legal in every state.

I think the most surprising is the unanimous verdict. Now, that's progress!

I wonder how strong the conservative base is in Iowa and can't help but think if a Prop.8 equivalent will show up on the Iowa ballot soon amending the state constitution.

So, if it sticks... that's 3/50. Hopefully we will start seeing a domino effect with alot of progressive states. I wonder if we can double that number (to 6 states) by the next Presidential election.

The thing about Iowa is, while it is a relatively democratic state, the christian right rules the conservatives. That's why Mike Huckabee did so well here in the caucus, the republican's are in the minority, more and more everyday, since the young population is largely democratic, but the conservatives are usually religious. I have heard that legislation against it is already beginning, but hopefully we will at least have some time before they manage to do a prop 8 type deal.

Well at the earliest it would show up in like 2014. It needs to be voted for in two straight terms of the state congress, and the democratic party's leadership doesn't want it to.

I would say New Hampshire. A bill just passed the NH house and is off to to the NH senate.

Nate Silver over at FiveThirtyEight has a cool statistical look at it. He thinks that currently these states would vote against a ban on gay marriage, which includes a few states that have previously voted for a ban:

Vermont
New Hampshire
Massachusetts
Maine
Rhode Island
Connecticut
Nevada*
Washington
Alaska*
New York
Oregon*

Followed by a few each year, with Mississippi finally coming around in the year 2024. He based this on polls that show support for gay marriage increasing by 2 percent each year, and looked at how each state polled in 2008.

I like how he anticipates the deep south taking the longest. They always have been opposed to two things: change and logic.

No matter where you go on earth there will be plenty of gay bashers and plenty of gays. End of story. I shouldn't have said anything about the south at all, regardless, I just hope everyone comes around to the logical way of thinking and gets over their "ick" factor when addressing gays.

The Governor of Iowa has come out against an amendment to ban gay marriage. Holy smokes.

Culver said in a lengthy statement that he hadn't changed his mind that marriage is between a man and a woman: "This is a tenet of my personal faith."

However, Culver said the issue before the court in its unanimous ruling Friday involved only civil marriage, and that churches and other religious institutions do not have to perform them.

"The court also concluded that the denial of this right constitutes discrimination," Culver said. "Therefore, after careful consideration and a thorough reading of the court's decision, I am reluctant to support amending the Iowa Constitution to add a provision that our Supreme Court has said is unlawful and discriminatory."

Key Democratic legislative leaders have ruled out efforts to start the process of amending the constitution, and Culver's position likely ends that debate for all practical purposes. Social conservatives have been clamoring for the amendment, but even in their best-case scenario Iowa voters could not weigh in on the issue until 2012.

That's balls!

Congrats to Iowa residents for having a governor with integrity (at least on this one issue).

Seriously, great news, and it opens the door to take the case to the supreme court.

We now have a solid precedent especially with the unanimous decision that could allow for the federal supreme court to intervene. That is GREAT news, considering the law has historically been the thing going for gay marriage and the population were the thing going against it. If it comes to the supreme court, I have great faith rights will be equal soon

The easiest path to the supreme court is as follows:

Couple gets married in Iowa.
Couple moves to a state with an amendment banning gay marriage.
Couple demands rights recognized by previous state in new state.
Couple is denied.
Couple sues.

The above leads to a clear cut case where the supreme court would consider taking the case, assuming the state's own court doesn't overturn the amendment, which then sets a precedent. Either way, the ball's rolling downhill and unless there is a dramatic change in terrain, it's becoming an inevitability that equal rights are coming.

I don't want it to go to the Supreme Court right now, not with that homophobe Scalia and his fanatical buddies Alito and Thomas there.

Does that really matter? Kennedy voted with Stevens, Breyer, Souter, and Ginsburg in Lawrence and Romer which, contrary to Kennedy's claims in those cases (which he authored), lend support to the idea of a right to marriage for gays.

I think there is clearly 5 votes on the court now that would recognize such a right if a good case came along. I doubt they'd even take the easier, and more narrow FF&C argument presented in the case, and would instead base the opinion on the Equal Protection clause. Roberts and Alito are the only justices whose opinions are not clear, but I doubt they'd matter either way.
