Only two other US states currently recognize same-sex marriage -- Connecticut and Massachusetts -- while nine others grant some of the legal benefits of marriage to gay couples through "civil unions" or domestic partnership laws. While our state constitution prohibits same-sex marriage in Wisconsin, Wisconsinites overwhelmingly share a commitment to fairness and decency for all couples. Gay Marriage is Legal I'm surprised no one has picked up on this and put a thread for it yet. The Iowa supreme court ruled UNANIMOUSLY that prohibiting gay marriage is unconstitutional, and consequently legalized it. It will take 21 days to process, but on April 24th gay marriage will be officialy legal in the state of Iowa. I wonder how strong the conservative base is in Iowa and can't help but think if a Prop.8 equivalent will show up on the Iowa ballot soon amending the state constitution.
So, if it sticks... that's 3/50. Hopefully we will start seeing a domino effect with alot of progressive states. I wonder if we can double that number (to 6 states) by the next Presidential election.

The thing about Iowa is, while it is a relatively democratic state, the christian right rules the conservatives. That's why Mike Huckabee did so well here in the caucus, the republican's are in the minority, more and more everyday, since the young population is largely democratic, but the conservatives are usually religious. Well at the earliest it would show up in like 2014. It needs to be voted for in two straight terms of the state congress, and the democratic party's leadership doesn't want it to.

I wonder what state will be next? I would say New Hampshire. A bill just passed the NH house and is off to to the NH senate. Nate Silver over at FiveThirtyEight has a cool statistical look at it. He thinks that currently these states would vote against a ban on gay marriage, which includes a few states that have previously voted for a ban: Vermont New Hampshire Massachusetts Maine Rhode Island Connecticut Nevada* Washington Alaska* New York Oregon* Followed by a few each year, with Mississippi finally coming around in the year 2024. Culver said in a lengthy statement that he hadn't changed his mind that marriage is between a man and a woman: "This is a tenet of my personal faith."
However, Culver said the issue before the court in its unanimous ruling Friday involved only civil marriage, and that churches and other religious institutions do not have to perform them.
"The court also concluded that the denial of this right constitutes discrimination," Culver said. "Therefore, after careful consideration and a thorough reading of the court's decision, I am reluctant to support amending the Iowa Constitution to add a provision that our Supreme Court has said is unlawful and discriminatory."
Key Democratic legislative leaders have ruled out efforts to start the process of amending the constitution, and Culver's position likely ends that debate for all practical purposes. Social conservatives have been clamoring for the amendment, but even in their best-case scenario Iowa voters could not weigh in on the issue until 2012.

Couple gets married in Iowa.
Couple moves to a state with an amendment banning gay marriage.
Couple demands rights recognized by previous state in new state.
Couple is denied.
Couple sues.
The above leads to a clear cut case where the supreme court would consider taking the case, assuming the state's own court doesn't overturn the amendment, which then sets a precedent. Either way, the ball's rolling downhill and unless there is a dramatic change in terrain, it's becoming an inevitability that equal rights are coming.

Kennedy voted with Stevens, Breyer, Souter, and Ginsburg in Lawrence and Romer which, contrary to Kennedy's claims in those cases (which he authored), lend support to the idea of a right to marriage for gays. I think there is clearly 5 votes on the court now that would recognize such a right if a good case came along. I doubt they'd even take the easier, and more narrow FF&C argument presented in the case, and would instead base the opinion on the Equal Protection clause. Roberts and Alito are the only justices whose opinions are not clear, but I doubt they'd matter either way.
