The case seems weak. It hinges on the accusation that Goldman didn't disclose Paulson & Co's role in the selection of securities it sold, but according to this article, the SEC has testimony from Paulson & Co executive that contradicts that point. At the end of the day, this isn't Martha Stewart they're going after; I'm sure GS has a lot of weapons in its arsenal to fire back against SEC.
