What is punishable is the intent. You have to intend to harass someone and cause them harm; that's what's illegal. It's illegal even if you do not actually cause the harm.

If I do not intend to harm you and you are harmed anyway, I am not guilty. I didn't intend to do so.

It was this Congress that has allowed warrantless searchers to continue, the war(s) to continue, did nothing to impeach Bush or Cheney (which I was all for, but they left Kucinich and Co. high and dry) and lastly plunged our country into an endless hole with the Bailout Bill. In summation, the Democratic Congress screwed the American people these last two years and the ONLY reason they didn't stand up against Bush and Co. was because they wanted to get things passed just for the sake of doing so to improve their election chances this Nov. 4.
