The immunity only pertains to civil cases. There is no need to immunize them from criminal charges because the president can pardon anyone he wants for any reason. And the expectation is that Bush will pre-pardon the telcos against any potential criminal charges before he leaves office.

The wishful thinking is that Obama as president would advocate a challenge of the constitutional validity of the law. I'm not so sure about that. Nor can I make sense of Obama's stance for purely political gain. Given that he voted repeatedly for amendments stripping the telco immunity, Obama must simply have felt that this was a workable and practical compromise even if the immunity couldn't be taken out of it.
I think it's a bad law and I disagree with him on that for sure.
